Terms of Service#

These Terms and Conditions ("Migration Offer Terms") govern the migration discount offer provided by FatSync Software Private Limited ("Spike," "we," "us," or "our") to eligible customers who migrate from another incident management platform to Spike.

By redeeming this offer, you agree to be bound by these Migration Offer Terms in addition to Spike's standard Terms of Service and Privacy Policy.

Qualifying Providers#

This offer applies only to customers migrating from recognized incident management platforms ("Qualifying Providers"), including but not limited to:

  • OpsGenie by Atlassian
  • Splunk On-call (VictorOps)
  • PagerDuty
  • Squadcast
  • Zenduty
  • xMatters

Spike may update or expand this list at its discretion.

Eligibility#

  1. This offer is available to customers who are actively using a qualifying incident management platform listed above.
  2. The offer is available only to first-time Spike customers.
  3. To qualify for the automatic 50% discount, you must provide proof of an active subscription with a qualifying provider with annual payments of $200 USD or more.
  4. Customers paying less than $200 USD annually may still be eligible for a discount, subject to review and approval by Spike's sales team.
  5. Enterprise customers may receive up to 50% off, with final discount rates determined on a case-by-case basis by Spike's sales team.

Offer Details#

  1. Eligible customers will receive a 50% discount on their first year of Spike subscription.
  2. The discount applies to equivalent service tiers and user counts as your current incident management provider.
  3. The discount is applied at checkout when using the provided coupon code.
  4. This offer cannot be combined with other promotional discounts or offers.

Coupon Usage#

  1. Each coupon code is unique and tied to the specific organization transitioning from a qualifying provider to Spike.
  2. Coupon codes are non-transferable and cannot be shared with or used by other organizations.
  3. Any attempt to share, transfer, or sell the coupon code will result in immediate invalidation.

Validity Period#

  1. This migration offer and associated coupon codes are valid for one (1) month from the date of issuance.
  2. All coupon codes must be redeemed before the expiration date indicated in your offer communication.
  3. Expired coupon codes cannot be extended or reissued except at Spike's sole discretion.

Service Terms#

  1. After the discounted period ends, standard Spike pricing will apply to subsequent renewal periods.
  2. All other aspects of the service relationship are governed by Spike's Terms of Service, Service Level Agreement, and Privacy Policy.

Verification#

  1. Spike reserves the right to verify your subscription status with a qualifying provider before applying the discount.
  2. You may be required to provide documentation confirming your active subscription and payment amount.
  3. Providing false information to qualify for this offer constitutes a violation of these terms and may result in termination of your Spike account and services.

Right to Refuse#

Spike reserves the right to reject or deny this offer to any individual or organization at its sole discretion, even if eligibility criteria appear to be met.

This may include, but is not limited to, cases where fraudulent activity is suspected, incomplete information is provided, or where extending the offer would conflict with Spike’s business interests.
